- TCISkimmer Lite license is INDIVIDUAL and based on Yearly Subscription schema. License validity period started from the date license issued, not from the date you first time run the software. Extra 7 days added to the license assuming you need some time to download the software and set it up, hence effectively license is valid for 365+7 days. Expired subscription means application will not be operable until the subscription is renewed. Please note that this operation model is effective now and will be changed in future towards simplification, including multi-year subscription, bundling, etc.
- KYC procedure is mandatory for this product, you will be asked about your HW, SW and you have to accept general Terms and Conditions and this Terms and Conditions. No KYC – no purchase.
- No physical product is issued or/and posted; instead you provided with your individual downloadable copy of the TCIskimmerLite software for selected OS platform, licensed uniquely to your primary Call Sign and contest Call Sign (if it is different from primary).
- License is issued against your official HAM radio call sign(s). License is non-transferrable, the software can be legally used only by the operator, who’s callsign it is licensed for. The terms are slightly different based on license types and at the moment of purchase:
- for Basic and Trial license only your primary call sign is required;
- for Advanced and DX we will require your primary call sign and your contest call sign. If you do not possess dedicated contest call sign, then please make sure you tick the box “contest callsign same as primary” in your Account Profile.
- Skimmer Trial can be only produced once per single account/customer. Skimmer Trial is limited for 14 days and cannot be extended.Skimmer Trial is zero price and issuing Trial license is the subject for approval, which cannot be guaranteed.
- Collective stations, HAM radio groups, DXpeditions, etc. are only eligible for Advanced or DX versions. We are not checking your group status on selection and checkout, the responsibility of selecting right product is yours.
- Each tier – Basic, Advanced and DX – has multiple OS supported: MacOS (Apple silicon and intel), Linux x64 and Windows x64 (10 and 11). You will be required to select at least one during the purchase.
- If you have purchased Basic license and later decided that you need and upgrade to Advanced or DX, please contact our support. Same applies if you want to upgrade Advanced to DX. Downgrading the license from DX to Advanced or Basic, or from Advanced to Basic is not supported. Upgrading the license does not reset license validity counter: this means if your purchase day is 1st of January and then you decided to upgrade on 1 of September – you will pay upgrading cost, but the validity period of you license will remain unchanged.
- One TCISkimmer Lite license gives you the right to run TCISkimmer Lite license on one selected PC/notebook only at the moment. Running same license copy on two or more machines at the same time is not supported. If you need to run two copies TCISkimmer Lite at the same time on two different PC, then you have to purchase second license. With one license you have and if you ordered two or more OS versions – you can freely select which one you are running at the time, with the conditions “one license for one machine at the time” met.
- Running second copy of the same license at the same machine is supported. This might be required if you want to use second instance of the TCISkimmer Lite for RX2 of your SunSDR transceiver. The second instance should be started with specific key and all information about the syntax, alongside with instructions for each OS is provided in the User Manual. Please note, that dependent on the Hardware, the CPU load with two running instances of TCISkimmer Lite will be twice, hence take care periodically checking to ensure you do not overload CPU to the level, when TCISkimmer Lite functionality is disrupted.
- Please make sure that you read Hardware Compatibility notes at product page. TCISkimmer Lite license cost will not be refunded just because you did not read Hardware Compatibility and purchased product which cannot run on your hardware/OS.
- You are obliged to use the software for legal purposes only. Use of TCISkimmer Lite in government or military services is directly prohibited.
- These Terms and Conditions are not covering “special” editions of the TCISkimmer Lite; “special” (customised) editions are subject of the dedicated Terms and Conditions.
- Third-Party Components
- TCIskimmer Lite incorporates third-party software components. A complete list of those components, together with their copyright notices and full licence texts, is included with every copy of the software in the “licenses” folder, and in particular in the file licenses/THIRD-PARTY-NOTICES.txt. Your use of those components is governed by their respective licences in addition to these Terms. Where a third-party licence grants you rights broader than those granted here, that licence prevails in respect of that component.
- TCIskimmer Lite uses the Qt framework version 6.10.3 under the GNU Lesser General Public License version 3. Qt is dynamically linked and is not modified. The complete corresponding source code of Qt 6.10.3 is available at https://download.qt.io/archive/qt/6.10/6.10.3/single/ ; should that location become unavailable, a copy will be provided on request through support.
- Reverse Engineering and Protection Mechanisms
- 14.1 Except as permitted by clauses 14.2 and 14.3, you may not decompile, disassemble, reverse engineer, translate object code into source form, extract, or otherwise attempt to derive the source code, algorithms, internal data structures, neural-network model weights, filter or channeliser coefficients, or licensing logic of the software; nor circumvent, disable, bypass or tamper with any licence-verification, activation, serial-binding or content-protection mechanism; nor remove, obscure or alter any copyright, trademark or licence notice contained in or delivered with the software.
- 14.2. Nothing in clause 14.1 limits any right granted to you by the licence of a third-party component referred to in clause 13. In particular, clause 14.1 does not restrict your right to modify Qt, to relink the software against a modified version of Qt, or to reverse engineer the software to the extent necessary to debug such modifications. The software is not, and shall not be treated as, an effective technological measure within the meaning of Article 11 of the WIPO Copyright Treaty against any act carried out in the exercise of those rights.
- 14.3. Clause 14.1 applies only to the extent permitted by applicable mandatory law and does not restrict acts which such law permits notwithstanding any agreement to the contrary, including decompilation necessary to obtain information required to achieve interoperability of independently created software with the software.
- 14.4. Subject to clauses 14.2 and 14.3, clause 14.1 applies in full to all remaining parts of the software, including its decoder implementations, its neural-network models and their encrypted containers, its channeliser profile data, its callsign and prefix databases, and its licence-verification subsystem.
- Ownership and Reservation of Rights
- 15.1. The software is licensed, not sold. All right, title and interest in and to the software, including all intellectual property rights in its source code and object code, its decoder implementations, its neural-network models and the data used to train them, its coefficient and profile data, its databases, its user interface, its documentation and its branding, remain with the Licensor and the Licensor’s licensors. Except for the limited rights expressly granted by these Terms and by the licences of the third-party components referred to in clause 13, no rights are granted to you, whether by implication, estoppel or otherwise.
- 15.2. You may make one copy of the software for backup purposes. You may not sublicense, rent, lease, lend, sell, redistribute, publish, host, or otherwise make the software available to any third party, in whole or in part, nor use it to provide a service to any third party, except as expressly permitted by these Terms.
- No Warranty
- 16.1. The software is provided “as is” and “as available”, without warranty or condition of any kind, whether express, implied or statutory, including without limitation any implied warranty of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment or non-infringement.
- 16.2. In particular, the Licensor does not warrant that the software will operate uninterrupted or free of defects, that it is compatible with any particular hardware, transceiver, operating system or third-party program, or that call signs, spots, frequencies, log entries, multipliers or contest scores produced by the software will be accurate or complete. Decoding of radio signals is inherently probabilistic. You are solely responsible for verifying any data produced by the software before relying on it, including before submitting a contest log or an award application.
- 16.3. Nothing in this clause excludes or limits any guarantee, warranty, condition or right which cannot lawfully be excluded or limited under mandatory consumer protection law applicable to you.
- Limitation of Liability
- 17.1. To the maximum extent permitted by applicable law, the Licensor shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of profit, revenue, data, logs, contest results, awards, goodwill, business or opportunity, arising out of or in connection with the software or these Terms, regardless of the theory of liability and even if the Licensor has been advised of the possibility of such loss.
- 17.2. To the maximum extent permitted by applicable law, the total aggregate liability of the Licensor arising out of or in connection with the software or these Terms shall not exceed the amount actually paid by you for the licence during the twelve (12) months immediately preceding the event giving rise to the liability.
- 17.3. Where liability cannot lawfully be excluded but may be limited, the liability of the Licensor is limited, at the Licensor’s option, to re-supplying the software or to paying the cost of having the software re-supplied.
- 17.4. Nothing in this clause excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded or limited.
- Governing Law, Jurisdiction and Severability
- 18.1. These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of UAE, without regard to its conflict of laws rules.
- 18.2. The courts of UAE shall have exclusive jurisdiction over any such dispute or claim, save that, where you contract as a consumer, this clause does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence, nor of the right to bring proceedings before the courts of that country.
- 18.3. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
- 18.4. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid or unenforceable provision shall be treated as replaced by a valid provision which most closely reflects its original intent.
- Changes to These Terms
- 19.1. The Licensor may amend these Terms from time to time, including to reflect changes in the software, in the licensing model, or in applicable law.
- 19.2. Amendments do not apply retrospectively. The version of these Terms in force on the date you purchased or last renewed your licence continues to govern that licence for the whole of its validity period. Amended Terms apply to purchases and renewals made on or after their effective date.
- 19.3. The current version of these Terms is published at https://shop.advancedradio.net/tciskimmer-lite-usage-terms-and-conditions/ and is included with each copy of the software. Each version carries an effective date.
- 19.4. Where an amendment materially reduces your rights and the Licensor nevertheless needs it to take effect during a validity period already paid for, the Licensor will notify you by email to the address associated with your account not less than thirty (30) days before it takes effect. If you do not accept the amendment, you may terminate your licence by notice before it takes effect and receive a refund proportionate to the unexpired part of the validity period.
- 19.5. Amendments required by applicable law, or necessary to address a security risk, may take effect on shorter notice, and in that case the Licensor will notify you as soon as reasonably practicable.
